Terms and Conditions:
1. Acceptance of Orders: An order shall not be valid, nor shall it be a binding contract upon the Company, unless it is in accordance with these terms and conditions and shall have been received and approved at the Company’s offices in Costa Mesa, California. All sales are final on custom orders and all deposits are non-refundable. Changes may not be made once an order is placed.
2. Notice of Changes: Prices, terms and conditions of sale are subject to change without notice. When the Company makes any price increase, the Company will endeavor to mail a general notice to the trade before the effective date of such price change, although the Company does not guarantee any such notice.
3. Terms of Payment: All sales are made on a cash basis, unless and until credit is extended. Credit may be granted upon receipt from the buyer of up-to-date trade references along with current banking information. When credit is granted, the terms of payment are 30 days net. A CASH DISCOUNT OF 2% WILL BE ALLOWED FOR PAYMENT RECEIVED WITHIN 10 DAYS FROM THE DATE OF THE INVOICE, PROVIDED NO OTHER INVOICES ARE PAST DUE.
4. Credit Card Payments: Visa, MasterCard, Discover, Diners Club and American Express are accepted upon card approval.
5. Freight Policies and Method of Shipment: All items are shipped FOB Ex-Factory. In the absence of specific instructions from the buyer, the Company will ship by freight, express, parcel post or truck in the manner deemed most satisfactory based upon convenience, experience and cost.
6. Specification of Tolerances: All custom orders will be made as close to specified dimensions as possible. Because of the nature of custom hand craftsmanship, certain measurements may vary from specified dimensions. Unless specific tolerances are specified we reserve the right to alter dimensions as we see fit.
7. Claims and Returns: All products are inspected before they leave the company. Likewise, all shipments must be checked and inspected upon delivery. The customer must file claims for damages against freight carriers within 72 hours of receipt of goods. Additionally, any shortages must be reported directly to the carrier and Aaron R. Thomas Design upon receipt of goods. Failure to report damage or shortages as outlined above may be cause for your freight claim to be denied. Damaged or defective goods may be returned to the Company upon receipt of a written return authorization signed by the Company. All requests must be made in writing within 72 hours of receipt of goods.
8. Opening Orders:Opening orders of $2,000 or more will qualify for net 30 terms, provided the conditions set forth in item 3 are met. Smaller opening orders will be accepted, however, the terms of the sale will be 50% deposit with the order and the balance due before delivery. Payment must be made by check or credit card.
9. Storage of Finished Orders: Unfortunately we do not have room to store finished orders. Any order left five days after notification of completion will be subject to a $25 per day storage fee. Any order left over 30 days after notification of completion will become property of Thomas Plastic Design, Inc. to be disposed of at our discretion
